GENERAL CONTRACTING CONDITIONS

The following is the contractual document that will govern the purchase and sale of products and services through the website www.magomhrc.com, owned by Magom Hidráulica RC, SL (hereinafter the provider). Acceptance of this document implies that the user:
a) You have read, understand and comprehend what is stated herein.
b) That he is a person with sufficient capacity to contract.
c) That it assumes all the obligations set forth herein.

These conditions will have an indefinite period of validity and will be applicable to all contracts made through the provider's website.
The provider reserves the right to unilaterally modify these Conditions, without this affecting the goods or promotions that were acquired prior to the modification.

Identity of the parties

POn the one hand, the provider of the goods or services contracted by the user is Magom Hidráulica RC, SL, with registered office at C/ Pilar Aranda La Torre 17 in Jerez de la Frontera (Cádiz) C.I.F. B-11935624, registered in the Mercantile Registry of Cádiz Volume 2208 Folio 5 Section 8 Sheet CA-50181 Entry 1 and with customer service telephone number +34 856 398112

On the other hand, the guest client or user, registered on the website using a username and password, has full responsibility for the use and custody of the user, and is responsible for the veracity of the personal data provided to the provider. The user confirms that he/she is over 16 years of age and has the capacity to enter into contracts.

Purpose of the Contract

The purpose of this contract is to regulate the contractual relationship between the provider and the user when the latter accepts the corresponding box during the online contracting process.
The contractual relationship of sale entails the delivery, in exchange for a price determined and publicly displayed through the website, of a specific product or service offered on the website.

Contracting procedure

The contracting procedure can only be carried out in the languages ​​selected at the top of the website. If it could be carried out in another language, this will be indicated before starting the contracting procedure.
In order to access the services offered by the provider, the user must register through the website by creating a user account or as a guest. To do so, the user must freely and voluntarily provide the personal data that will be required.
The user will select a username and password, agreeing to use them diligently and not to make them available to third parties, as well as to notify the provider of their loss or theft or of possible access by an unauthorized third party, so that the provider can immediately block them. The guest will provide a valid email address. 

Likewise, the User undertakes to make appropriate and diligent use of his/her username and password, being solely responsible for any illegal use or use contrary to these General Conditions and the Specific Conditions that apply in each case.
The user may not choose as a username words that are intended to confuse others by identifying him or her as a member of the provider, as well as expressions that are foul, insulting and, in general, contrary to the law or the requirements of morality and good customs.

Once the user account has been created, please be advised that in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the following steps, namely:


1. Select one or more items from the catalog
2. Shopping cart
3. Login or Register or proceed as a guest
4. Payment for the purchase
5. Purchase confirmation

Once you have made the payment for your order, you will receive an email confirming your purchase, in which you will be able to see all the products you have purchased and the reference number of your order.

PREPARATION

The user will receive an email indicating the start of preparation of their order, followed by an email sent from [email protected] indicating the estimated shipping date.

Each item has a handling (manufacturing) time specified below the item name.

Most of the items in our catalogue are personalised, meaning they are manufactured or handled to order.

If the order is out of stock but available for purchase with a PRE-ORDER text, the customer will receive an email confirming and accepting the reservation of the product. As soon as the product is available, they will receive a message notifying them that their order is being prepared and an estimated shipping date. The manufacturing time is calculated from the beginning of the preparation of the order.

MODIFICATION

Once payment has been received, if you wish to modify your order (for example: add or remove items, change the selected carrier), you must contact us through any form of customer service contact. We will proceed with the corresponding modification. The response time may vary between 24/48 hours (working days), and may be longer during periods of greater demand.

If you have placed two orders that are in preparation and you wish to have them shipped together, the extra shipping cost will be converted into credit that you can use on our website through a coupon associated with your customer account. Refunds of this coupon are not permitted.

CANCELLATION

The user can cancel the order if it has not been shipped and if it is not a product with their own specifications. They have a period of 14 days to cancel the order and obtain a refund without having to justify it, except for personalized products. The refund may be subject to management costs, and the amount to be refunded will not be greater than the amount received. After 14 days, if you wish to cancel your order, the cost associated with the cancellation will be assessed, depending on the production status.

If the order has been shipped, no modification or cancellation will be allowed.

RETURN

If you wish to make a return, it will be accepted up to 30 days after delivery of the order. The return of items does not include, under any circumstances, the return of shipping costs. Returns of items that have been manipulated, used or have specific specifications are not accepted.

SHIPMENT

Once the order has been sent, you will receive an email with the shipping confirmation and the tracking number, except in the case of Correos SN, which does not have tracking. You can also check the package tracking information in your order history in your customer profile on our website.

Shipping times are determined by each carrier, which has its own terms and conditions. MAGOM HRC will be the intermediary between the user and the selected carrier. The responsibility for the data and transport conditions lies with the transport company responsible for the shipment. 

Orders destined for outside the European Union will be subject to payment of the corresponding customs fees established by each country. The stipulated delivery time of each carrier does not include preparation time or customs processing time.

The provider assumes no responsibility when the delivery of the product or service does not take place as a result of the data provided by the user being false, inaccurate or incomplete or when the sale cannot be carried out for reasons beyond the control of the provider.

WARRANTY

The items offered in our online store are a selection of MAGOM HRC products and those of third-party companies. The warranty for each product is set by the respective manufacturer. For MAGOM HRC products, the warranty applies under proper use and in accordance with the instructions provided:

  • Duration: The warranty lasts for one year.
  • Coverage: The warranty only covers manufacturing, shipping or packaging problems. The warranty does not cover errors or poor customization of the product by the customer. If the product has already been inspected at our facilities and its correct operation and quality has been certified, the warranty will only be offered if the warranty itself has been damaged in transport or if it is a different product than the one inspected.
  • Transport Damage: If your order is damaged during transport, we will need evidence from the outside of the packaging to claim the guarantee from the carrier. It is the customer's responsibility to check the purchased items upon receiving the package. After the carrier claim or return period has passed, MAGOM HRC will not be responsible for the condition of the products.
  • Warranty Exclusions: The warranty does not cover problems or damage caused by misuse or manipulation of the product. This warranty will be voided if the product has been modified or tampered with.
  • Warranty Shipping: With standard shipping. If the customer wants a faster shipping method, they must request it and pay the difference.

Use of the Website, its Services and Contents.

The User undertakes to use the Website, its services and content without contravening current legislation, good faith, generally accepted uses and public order.
Likewise, the use of the website for illegal or harmful purposes against MAGOM HRC or any third party, or which, in any way, may cause harm or prevent the normal operation of the website is prohibited.

Regarding content (information, text, graphics, sound and/or image files, photographs, designs, etc.), the following is prohibited:

  • Its reproduction, distribution or modification, unless authorized by its legitimate owners or legally permitted.
  • Any violation of the rights of the Provider or its legitimate owners over them.
  • Its use for any type of commercial or advertising purposes, other than those strictly permitted.
  • Any attempt to obtain the contents of the website by any means other than those made available to users as well as those normally used on the Internet, provided that they do not cause any damage to the Provider's Website.

The Provider informs that the relationship with its clients through this Web service is a private commercial relationship, exactly the same as that established through the physical point of sale, and always subject to the regulations.

Price and offer validity period

The prices indicated for each product include Value Added Tax (VAT) according to the country from which the user enters. Other taxes or duties are not included. Non-EU customers make their purchase exempt from VAT. Prices will be expressed in Euro (€) or US Dollar ($) as selected in the top bar of the website. These costs, unless expressly stated otherwise, do not include the costs of other additional services annexed to the product or service purchased.
The prices applicable to each product are valid except for out-of-stock situations or typographical errors and will be those published on the website and applied automatically by the contracting process in the last phase of the same. The customer assumes that in any case the economic valuation of some of the products may vary in real time. In any case, this will always be communicated previously to the users.
Every payment made to the provider will entail the issuance of an invoice in the name of the registered user or guest. This invoice will be automatically generated. The user can access it through the website. The delivery note will be sent together with the purchased product.
If you are buying from a European Union country, your invoice will contain the corresponding VAT of your country, which will be collected by MAGOM HRC and deposited in the corresponding country.
If, on the contrary, you are buying from a country that does NOT belong to the European Union, your invoice will be without VAT. Taxes will be collected by the customs of the destination country.
In the case of an intra-community company, you must contact us before purchasing so that we can generate your invoice correctly.
The payment of shipping on our website only corresponds to the MAGOM HRC - CUSTOMER shipment. In no case does it cover customs costs or return costs in the event that the package is not delivered due to non-payment of customs, failure to pick up the package at a delivery point, or delivery error due to an incorrect address provided by the customer.For any information about the order, the user may call the provider's customer service telephone number which is +34 856 398 112 or via email at [email protected]. In any case, the order number assigned and indicated in the purchase confirmation email must be mentioned in the subject of the message or to the operator.

Disclaimer of warranties and liability

The Provider does not provide any guarantee nor is it responsible, in any case, for damages of any kind that may arise due to:

  • The lack of availability, maintenance and effective operation of the website and/or its services or contents.
  • The lack of usefulness, suitability or validity of the website and/or its services or content to satisfy the needs, activities or specific results or expectations of users.
  • The existence of viruses, malicious or harmful programs in the content.
  • The reception, obtaining, storage, dissemination or transmission, by users, of the contents.
  • The illicit, negligent, fraudulent use, contrary to these General Conditions, good faith, generally accepted uses or public order, of the website, its services or contents, by users.
  • The lack of legality, quality, reliability, usefulness and availability of the services provided by third parties and made available to users on the Web.
  • Failure by third parties to comply with their obligations or commitments in relation to the services provided to users through the website.

Liability for errors

The Provider declines all responsibility for the use made of the data published here. All information and data offered on this site are reviewed before publication; however, it is not possible to guarantee 100% that they are free of errors or incorrect translations, so users and visitors are advised to be aware of updates that are made periodically, and not to make any decision based solely on the information offered by this website.

USER RESPONSIBILITY

In general, the user or buyer is obliged to comply with the duties arising from these terms and conditions, as well as to comply with the special warnings or instructions for use contained therein or on the pages of the site and to always act in accordance with the law, good customs and the requirements of good faith, refraining from using the elements of the site in any way that may prevent, damage or deteriorate its normal operation, the assets and/or rights of MAGOM HRC, its clients and suppliers, collaborators, users and, in general, any third party.
MAGOM HRC reserves the right to block and/or not sell to users who have acted or have publicly damaged the name of MAGOM HRC.

RESOLUCIÓN

In the event of non-payment by the buyer within 15 days (in any payment method), MAGOM HRC is entitled to cancel the order without notice.

Ley aplicable y jurisdicción

These conditions shall be governed or interpreted in accordance with Spanish law in all matters not expressly stated. The provider and the user agree to submit any dispute that may arise from the provision of the products or services subject to these Conditions to the Courts and Tribunals of the user's domicile.
In the event that the user resides outside of Spain, the provider and the user expressly waive any other forum, submitting to the Courts and Tribunals of the city of Cádiz (Spain).
