Affiliate program - terms and conditions
This section contains the complete terms and conditions that apply to your participation as a MAGOM HRC affiliate with the Affiliate Program.
As used in this Agreement, “we”, “us” or “MAGOM HRC” means MAGOM Hidráulica RC, S.L.; and “you” or “Affiliate” means the affiliate. “MAGOM HRC Affiliate Program” means the program administered by MAGOM HRC.
Partner and referral program
Commission fees earned from the referral program will be 2% of products on qualifying shipped orders placed by customers who accessed the site through the affiliate link, 1.5% for ready-to-play models .
If the order is canceled or returned, resulting in a refund, the applicable fees will be canceled or withdrawn.
The customer or order will only be considered as referred by the affiliate if:
1. The order at MAGOM HRC is registered through the affiliate link provided by MAGOM HRC or by any other method agreed by MAGOM HRC
2. The account is registered with MAGOM HRC without participating in any special discount promoted by MAGOM HRC
3. The order is not placed by the affiliate himself.
The Affiliate can only enroll in the affiliate program by requesting it on the web through their customer account, pending manual approval by MAGOM HRC. If the Affiliate wishes to change the program, then the current program must be terminated first.
The affiliate program has a duration of one year with automatic renewal if more than 10 orders have been received through the Affiliate account in the period of one year from its creation or renewal.
Payment terms
Commission fees will be paid to the Affiliate upon request. Payment is made with a coupon containing the credit requested by the Affiliate. The credit can be requested whenever the Affiliate requires it with a maximum of one hundred euros (€100.00) per non-cumulative coupon.
Reports
You will have access to your general and specific statistics to which you will have access from the affiliate platform in your client account. You will be able to see clicks, earnings and confirmed orders for your Affiliate profile.
Representations and Warranties; limitation of liability
Each of us hereby represents and warrants that:
You have full power and authority to enter into this Agreement and to perform your obligations hereunder;
You have obtained all permits, licenses and other governmental authorizations and approvals required for your performance under this Agreement;
The services provided by each of us under this Agreement do not infringe or violate any patent, copyright, trade secret, trademark or other proprietary right of any third party.
MAGOM HRC will remain solely responsible for the operation of the MAGOM HRC website. MAGOM HRC acknowledges that its respective sites may be subject to temporary downtime due to causes beyond its reasonable control subject to the specific terms of this Agreement, retains the exclusive right and control over the programming, content and conduct of transactions on their respective sites or services.
MAGOM HRC is not responsible for any indirect, special, punitive or consequential damages (including lost profits or lost data) arising from this agreement.
MAGOM HRC will be solely responsible for providing the services paid for by the referred client. Accordingly, all MAGOM HRC rules, policies, operating procedures and information regarding client use will apply to such clients, including our privacy and confidentiality standards. We may change our policies and operating procedures at any time, without notice.
Intellectual Property Rights
MAGOM HRC hereby grants you for a period of one year a non-exclusive, non-transferable, royalty-free license to establish hyperlinks between your website and ours and to use MAGOM HRC trade names, logos on your site solely as reasonably necessary to establish and promote such hyperlinks and to otherwise perform your obligations under this Agreement; provided that any other promotional material or use containing any of MAGOM HRC's trade names, logos is subject to MAGOM HRC's prior written approval.
Except as set forth above, you and we reserve all respective rights, titles and interests in intellectual property rights (for example, patents, copyrights, trade secrets, trademarks and other intellectual property rights). The use of each other's trademarks, except as set forth herein, is strictly prohibited.
Duration and Termination
The term of this Agreement (the “Term”) will begin upon your acceptance of this Agreement and will end when terminated as described herein. You or we may terminate this Agreement at any time, with or without cause, by giving the other at least thirty (30) days' written notice of termination. You will only be able to earn commissions on sales occurring during the Term and commissions earned through the termination date will remain payable only if product orders are not cancelled.
If the Affiliate becomes inactive by not entering new referral orders, minimum 10 orders during a year, then we consider it appropriate to initiate the termination of the program by sending a notice.
The affiliate program and its links must not be used by the MAGOM HRC Affiliate itself or for the purpose of benefiting a single MAGOM HRC customer. Each MAGOM HRC client warrants and undertakes that they will actively work to promote the Affiliate Program and will actively work to attract new clients or orders to the Affiliate Program on an ongoing basis.
The original Spanish version of these terms and conditions may have been translated into other languages. The translated version is a courtesy and office translation and the client cannot obtain any rights from the translated version. In the event of a dispute over the content or interpretation of these terms and conditions or an inconsistency or discrepancy between the Spanish version and any other language version of these terms and conditions, the Spanish version, to the extent To the extent permitted by law, it will apply, prevail and be conclusive.
If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, the client will be bound by all other provisions of this document. In such event, such invalid provision will be enforced to the extent permitted by applicable law and the customer will accept, at a minimum, an effect similar to that of the invalid, unenforceable or non-binding provision, taking into account the content and purpose. of these terms and conditions.
